This software application and any accompanying information/materials or documentation ("Software") is the copyrighted work of epicsoft, LLC. All use of the Software is governed by the terms of this License Agreement that is provided below ("License Agreement"). The Software is solely for use by end users for the purpose of using the Software according to the terms of the License Agreement. Any use, reproduction or redistribution of the Software not in accordance with the terms of the License Agreement is prohibited.
The "Software" is MULE.
License Agreement
1. Grant of License:
Subject to the terms and conditions contained in this License Agreement, epicsoft, LLC hereby grants, and by installing the Software you thereby accept, a limited, non-exclusive license and right to install and use the number of licenses as specified in your purchase package for your use on either a home, business or portable computer for the purpose of using the Software.
2. Ownership:
All title, ownership rights and intellectual property rights in and to the Software and any and all copies thereof (including but not limited to any titles, computer code, and any related documentation) are owned by epicsoft, LLC or its licensors. The Software is protected by the copyright laws of the United States, international copyright treaties and conventions and other laws. All rights are reserved.
3. Limitation of Liability:
EPICSOFT, LLC SHALL NOT IN ANY CASE BE LIABLE FOR LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA OR INFORMATION, BUSINESS INTERRUPTION, OR ANY CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES, WHETHER DIRECT OR INDIRECT, ARISING FROM THE USE OF THE SOFTWARE OR THE OPERATION OF COMPUTER EQUIPMENT (INCLUDING WITHOUT LIMITATION THE RESULTS OF OPERATION OR CONTENT CREATED BY YOU OR THIRD PARTIES USING THE SOFTWARE TO FACILITATE NETWORK RENDERING PROCESSES OR OTHERWISE RESULTING FROM THIS AGREEMENT.
IN NO EVENT SHALL EPICSOFT, LLC BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF THE USE OR THE INABILITY TO USE THE SOFTWARE, EVEN IF EPICSOFT, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
We STRONGLY encourage you to make regular backups of your data.
4. DISCLAIMER OF WARRANTIES:
THE SOFTWARE AND ACCOMPANYING DOCUMENTATION IS BEING PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. EPICSOFT, LLC DOES NOT WARRANT THAT THE PROGRAM WILL BE UNINTERRUPTED OR ERROR FREE. EPICSOFT, LLC DISCLAIMS ALL WARRANTIES WHETHER EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
5. Purchase, Term and Termination:
The purchase price of Software is non-refundable. This License Agreement shall continue and remain uninterrupted for the duration of your use of the Software until terminated. You may terminate the License Agreement at any time by deleting all copies of the Software and all related information. epicsoft, LLC may terminate the License Agreement at any time for any reason by so notifying you; you must then promptly delete all copies of the Software and related information.
6. Contracting Parties:
If the Software is installed on computers owned by a corporation or other legal entity, then this License Agreement is formed by and between epicsoft, LLC and such entity. The individual executing this License Agreement represents and warrants to epicsoft, LLC that they have the authority to bind such entity to the terms and conditions of this License Agreement. You agree to defend and indemnify epicsoft, LLC against all claims, losses, liabilities, damages, costs and expenses, including attorney's fees, which epicsoft, LLC may incur in connection with your breach of this License Agreement.
EPICSOFT, LLC MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS SOFTWARE OR ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE BY THE SOFTWARE, FOR ANY PURPOSE. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. THIS SOFTWARE IS PROVIDED GRATUITOUSLY AND, ACCORDINGLY, EPICSOFT, LLC SHALL NOT BE LIABLE UNDER ANY THEORY OR ANY DAMAGES SUFFERED BY YOU OR ANY USER OF THE SOFTWARE.
epicsoft, LLC reserves the right at any time to alter prices, features, specifications, capabilities, functions, licensing terms, release dates, general availability or other characteristics of the Software.
7. Miscellaneous:
This Agreement shall be interpreted and construed according to, and governed by, the laws of Wisconsin, excluding any such laws that might direct the Software of the laws of another jurisdiction. The federal or state courts located in Wisconsin shall have jurisdiction to hear any dispute under this Agreement. This Agreement constitutes the entire agreement of the parties and supersedes all prior communications, understandings and agreements relating to the subject matter hereof, whether oral or written.
I hereby acknowledge that I have read and understand the foregoing License Agreement and agree that the action of installing the Software is an acknowledgment of my agreement to be bound by the terms and conditions of the License Agreement contained herein.
